Terms & Conditions

These Terms and Conditions govern your use of the Dimorphysique website, online coaching services, programs, consultations, forms, digital materials, and related services.

Effective Date: September 2, 2026

By accessing this website, submitting an application or consultation form, purchasing coaching, enrolling in a program, or otherwise using Dimorphysique services, you acknowledge that you have read, understood, and agreed to these Terms.

1

Services Provided

Dimorphysique provides online fitness and physique coaching services.

Depending on the coaching service selected, services may include:

  • Personalized resistance-training programs
  • Nutrition guidance
  • Calorie and macronutrient targets
  • Meal-planning guidance
  • Exercise selection and progression recommendations
  • Workout tracking and review
  • Progress monitoring
  • Weekly check-ins
  • Accountability
  • Educational fitness and nutrition resources
  • Adjustments to training and nutrition based on client progress
  • Direct communication and coaching support

The exact services provided may vary according to the coaching package purchased and the individual client's goals, circumstances, and needs.

Unless specifically stated otherwise, Dimorphysique services are provided remotely and do not include in-person personal training.

2

16-Week Coaching Commitment

Certain Dimorphysique coaching programs may require a minimum commitment of 16 weeks.

The 16-week period is intended to provide sufficient time to establish consistent habits, monitor progress, assess the client's response to training and nutrition, and make appropriate adjustments.

A 16-week program does not constitute a guarantee that a particular physique, body weight, body-fat percentage, amount of muscle gain, amount of fat loss, or other result will be achieved within 16 weeks.

Individual results vary.

Any specific payment schedule, renewal terms, or minimum commitment applicable to your coaching package will be disclosed before purchase.

3

Health and Medical Disclaimer

Dimorphysique provides fitness coaching and general nutrition education. Dimorphysique does not provide medical care, medical diagnosis, medical treatment, physiotherapy, psychotherapy, or other licensed healthcare services.

Information provided through coaching, the website, social media, consultations, meal-planning materials, training programs, or other Dimorphysique resources is for fitness, coaching, and educational purposes and should not be treated as a substitute for individualized medical advice from an appropriately qualified healthcare professional.

You are responsible for determining whether you are physically and medically capable of participating in an exercise or nutrition program.

You should consult an appropriate healthcare professional before beginning or materially changing an exercise or nutrition program if you have a medical condition, injury, illness, physical limitation, take medication that may affect exercise or nutrition, or otherwise have concerns regarding your health.

If you experience unusual or severe pain, dizziness, fainting, chest pain, difficulty breathing, or another potentially serious symptom during exercise, stop exercising and seek appropriate medical attention.

4

Nutrition Disclaimer

Nutrition information provided by Dimorphysique is intended as general fitness and nutrition coaching and education.

Unless a service is expressly provided by an appropriately licensed or regulated healthcare professional, Dimorphysique does not diagnose or treat nutritional deficiencies, eating disorders, metabolic disorders, diseases, allergies, or other medical conditions.

Clients are responsible for informing Dimorphysique about relevant food allergies, intolerances, dietary restrictions, medical advice, and other circumstances that may affect their nutrition.

Clients should seek advice from a physician, registered dietitian, or other qualified healthcare professional where individualized medical nutrition therapy is required.

5

Assumption of Risk

You understand that resistance training, cardiovascular exercise, physical activity, changes in diet, and participation in fitness programs involve inherent risks.

These risks may include, among other things:

  • Muscle soreness
  • Strains and sprains
  • Falls
  • Equipment-related injuries
  • Aggravation of an existing injury or condition
  • Fatigue
  • Illness
  • Changes in body weight or body composition
  • Other physical injuries or adverse effects

More serious injuries may occur in rare circumstances.

By voluntarily participating in Dimorphysique coaching, you acknowledge and accept the ordinary and inherent risks associated with exercise and fitness activities.

You are responsible for exercising within your abilities, using equipment appropriately, maintaining a reasonably safe training environment, and informing your coach of injuries, limitations, or other relevant concerns.

6

Client Responsibilities

To receive effective coaching, clients are expected to participate actively and honestly in the process.

You agree to:

  • Provide accurate information about your goals, training history, experience, limitations, and relevant health circumstances
  • Inform your coach about injuries, pain, physical limitations, or other issues that may affect your training
  • Use reasonable judgment when performing exercises
  • Follow equipment safety instructions
  • Complete check-ins and provide requested information when reasonably necessary
  • Accurately report nutrition and training information to the best of your ability
  • Communicate problems or concerns that may affect your program
  • Use coaching materials for their intended purpose
  • Take responsibility for your own decisions and actions outside the scope of coaching

The quality of adjustments Dimorphysique can make depends partly on the accuracy and completeness of the information you provide.

7

Results Disclaimer

Dimorphysique does not guarantee specific results.

Fat loss, muscle gain, strength development, body composition, appearance, performance, and other outcomes vary substantially between individuals.

Results may be influenced by factors including:

  • Starting body composition
  • Genetics
  • Age
  • Training history
  • Exercise technique
  • Nutrition
  • Calorie intake
  • Protein intake
  • Consistency
  • Adherence
  • Sleep
  • Stress
  • Lifestyle
  • Recovery
  • Medical circumstances
  • Individual physiological response

Any testimonials, before-and-after photographs, transformations, case studies, statistics, or client results shown on the Dimorphysique website, advertisements, social media accounts, or other materials represent individual experiences.

They are provided for illustrative purposes and do not guarantee that you will achieve the same or similar results.

8

Progress Photos and Measurements

Clients may be asked to provide information such as:

  • Body weight
  • Measurements
  • Progress photographs
  • Nutrition records
  • Training logs
  • Strength performance
  • Recovery information
  • Hunger and energy levels

This information may be used to evaluate progress and make coaching adjustments.

Providing progress photographs to your coach for coaching purposes does not, by itself, grant Dimorphysique permission to publicly post, advertise, distribute, or otherwise use those photographs for marketing.

Separate permission will be obtained before identifiable client photographs or testimonials are used for promotional purposes where required.

9

Payments and Billing

Prices and payment terms will be disclosed before you purchase a Dimorphysique coaching service.

By purchasing a service, you authorize the applicable charges according to the payment arrangement you select.

Depending on the offer, payment may be made:

  • In full; or
  • Through an agreed installment or recurring-payment schedule.

You are responsible for maintaining a valid payment method where recurring payments have been authorized.

Failure to participate in coaching, complete check-ins, perform workouts, follow nutrition recommendations, or otherwise use the services made available to you does not automatically cancel an agreed payment obligation.

Any mandatory rights available to you under applicable consumer-protection law remain unaffected.

10

Cancellations and Refunds

Because coaching involves reserving coaching capacity and preparing individualized services and materials, payments are generally non-refundable once the applicable service has begun, except where a refund or cancellation right is required by applicable law or expressly provided in writing by Dimorphysique.

Any specific cancellation, refund, or termination conditions applicable to a coaching package will be disclosed before purchase.

If you wish to cancel or discontinue coaching, contact Dimorphysique as soon as possible.

Cancellation of coaching does not necessarily cancel payments already due under an agreed minimum commitment or payment plan, subject to applicable law and the specific agreement presented at purchase.

11

Chargebacks and Payment Disputes

If you believe a payment has been made incorrectly, contact Dimorphysique first so the issue can be reviewed.

Dimorphysique reserves the right to dispute chargebacks or payment reversals that it reasonably believes relate to validly authorized charges or services that were properly provided or made available.

Nothing in this section limits any rights you may have under applicable consumer- protection or payment-card laws.

12

Coaching Communication and Response Times

Clients may receive ongoing communication through the communication methods designated by Dimorphysique.

Dimorphysique aims to respond to client messages within approximately 24 hours, but response times are not guaranteed and may occasionally be longer because of weekends, holidays, illness, emergencies, technical problems, or other circumstances.

Messaging support is intended for reasonable questions related to your coaching program and should not be used for medical emergencies or urgent medical concerns.

For emergencies, contact the appropriate emergency services or healthcare provider.

13

Weekly Check-Ins

Depending on the coaching package, clients may receive regular or weekly check-ins.

Check-ins may review information such as body-weight trends, progress photographs, measurements, nutrition adherence, training performance, recovery, hunger, energy, sleep, and challenges experienced during the previous week.

Dimorphysique may use this information to adjust aspects of your program such as calories, macronutrients, exercises, training volume, or other coaching recommendations.

Clients are responsible for submitting requested check-in information accurately and on time.

Failure to complete a check-in may limit Dimorphysique's ability to assess progress or make appropriate adjustments.

14

Missed Check-Ins and Client Inactivity

If you do not submit a scheduled check-in or stop communicating with your coach, coaching availability and program access will not necessarily be paused or extended.

Unless otherwise agreed in writing, periods of client inactivity do not automatically extend the duration of a fixed-term coaching program.

Clients experiencing circumstances that prevent participation should contact Dimorphysique as soon as reasonably possible.

15

Program Adjustments

Training and nutrition programs may be modified throughout coaching based on information provided by the client and observed progress.

Adjustments may include changes to:

  • Calories
  • Macronutrient targets
  • Meal structure
  • Exercise selection
  • Sets and repetitions
  • Training volume
  • Training frequency
  • Exercise progression
  • Cardio or activity recommendations
  • Recovery strategies

Clients should not interpret an adjustment as evidence that previous recommendations were incorrect. Adjustments are a normal part of individualized coaching as circumstances and progress change.

16

Exercise Technique and Training Environment

Because Dimorphysique coaching is primarily provided remotely, your coach may not be physically present while you exercise.

You are therefore responsible for:

  • Using appropriate equipment
  • Following equipment instructions
  • Selecting appropriate loads
  • Maintaining a safe exercise environment
  • Stopping an exercise when you reasonably believe continuing would be unsafe
  • Seeking in-person professional assistance when necessary

Video demonstrations, written instructions, or technique feedback cannot eliminate all risks associated with exercise.

17

Third-Party Applications and Services

Dimorphysique may use or recommend third-party applications and services for purposes such as nutrition tracking, workout tracking, communication, video calls, scheduling, and payments.

These may include services such as Cronometer, Strong, Google Meet, Stripe, or other platforms.

Your use of a third-party service may be subject to that provider's own terms, privacy policy, fees, availability, and technical requirements.

Dimorphysique is not responsible for outages, errors, data loss, account restrictions, or other issues caused solely by independent third-party platforms.

18

Intellectual Property

Unless otherwise stated, Dimorphysique owns or has the right to use the materials provided through its website and coaching services, including:

  • Training programs
  • Workout templates
  • Nutrition resources
  • Educational materials
  • Written guides
  • Videos
  • Graphics
  • Website content
  • Branding
  • Program structures
  • Downloads and other coaching resources

Materials provided to you are for your personal, non-commercial use.

You may not reproduce, sell, publish, distribute, upload, license, share, or commercially exploit Dimorphysique materials without prior written permission.

Purchasing coaching does not transfer ownership of Dimorphysique intellectual property to you.

19

Website Use

You agree not to:

  • Use the Dimorphysique website for unlawful purposes
  • Attempt unauthorized access to the website or associated systems
  • Interfere with website functionality or security
  • Submit knowingly false or fraudulent information
  • Copy or commercially exploit protected website materials without permission
  • Impersonate another individual
  • Use the website in a manner that could damage or disrupt its operation

Submitting an application, questionnaire, or consultation request does not guarantee acceptance into coaching.

20

Right to Refuse or Terminate Coaching

Dimorphysique reserves the right, subject to applicable law and contractual obligations, to refuse a prospective client or terminate a coaching relationship where reasonably appropriate.

Reasons may include:

  • Abusive, threatening, discriminatory, or inappropriate conduct
  • Repeated non-payment
  • Fraudulent activity
  • Misuse or unauthorized distribution of coaching materials
  • Circumstances creating unreasonable safety concerns
  • A client's needs falling outside the reasonable scope of the coaching service
  • Serious or repeated breaches of these Terms

Where appropriate, clients may be referred to another type of professional whose services are better suited to their needs.

21

Limitation of Liability

To the fullest extent permitted by applicable law, Dimorphysique will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the website or participation in coaching services.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

To the extent permitted by applicable law, Dimorphysique's aggregate liability arising from a particular purchased service will not exceed the amount actually paid by you to Dimorphysique for that service giving rise to the claim.

22

Website Information

Dimorphysique makes reasonable efforts to provide useful and accurate information but does not warrant that all website content will always be complete, current, error-free, or appropriate for every individual.

Website content may be updated, removed, or modified without notice.

You are responsible for determining whether general information presented on the website is appropriate for your circumstances.

23

The Dimorphysique website may contain links to websites, applications, products, or services operated by third parties.

Links are provided for convenience or informational purposes and do not necessarily constitute an endorsement.

Dimorphysique does not control independent third-party websites and is not responsible for their content, availability, security, or privacy practices.

24

Privacy

Personal information submitted through the Dimorphysique website or coaching services will be handled in accordance with the Dimorphysique Privacy Policy.

Information collected may include details such as your name, email address, phone number, fitness goals, training history, nutrition information, and information you voluntarily provide as part of the coaching process.

Please review the Dimorphysique Privacy Policy for additional information regarding how personal information is collected, used, stored, and disclosed.

25

Electronic Communications

By submitting your contact information in connection with a consultation, application, purchase, or coaching service, you consent to receiving communications reasonably necessary to respond to your request and administer the service.

Marketing communications, where applicable, will be handled according to applicable consent and unsubscribe requirements.

26

No Transfer of Coaching Services

Unless Dimorphysique agrees otherwise in writing, coaching services, accounts, programs, and purchased packages are intended for the individual who purchased them and may not be transferred or resold to another person.

27

Force Majeure

Dimorphysique will not be responsible for delays or failures to perform caused by circumstances reasonably beyond its control, including major internet or telecommunications failures, natural disasters, government actions, widespread service outages, or other events that make performance impracticable.

Where possible, reasonable efforts will be made to resume affected services.

28

Governing Law

These Terms and any dispute arising from them or from Dimorphysique services will be governed by the applicable laws of the Province of Ontario and the federal laws of Canada applicable therein, without limiting any mandatory consumer rights that may apply based on your location.

29

Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, where permitted, and the remaining provisions will continue in effect.

30

No Waiver

If Dimorphysique does not immediately enforce a provision of these Terms, that does not constitute a waiver of the right to enforce that provision later.

31

Changes to These Terms

Dimorphysique may update these Terms from time to time.

The effective date shown at the top of this page indicates when the current version became effective.

Where required by law or contract, material changes affecting an existing paid coaching relationship will be communicated appropriately rather than applied retroactively solely by posting revised Terms.
